These terms and conditions govern your use of our Website. Please read the terms in full before you use this Website.

The contract between S.H.M Bodyworx and the Customer will be on these conditions, to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.

S.H.M Bodyworx Ltd will accept vehicles for repairs and examination with a view to estimating for repairs and for any other purpose necessary to complete the required Job.

Definitions

The Customer – The company or individual purchasing or placing an order with S.H.M Bodyworx.

Visitor – any person visiting our website, any of our promotional material, our place of business, or our social media accounts.

We/Us/Our (either capitalised or not) – S.H.M Bodyworx, S.H.M Bodyworx Ltd, S.H.M Bodyworx Accident Repairs Ltd, SHMBodyworx,  https://www.shmbodyworx.com

Work Order/Purchase/Work/Project/Repair/Job/Services – Any product, repair, work project or transaction made between S.H.M Bodyworx and the Customer.

Private Job/Private Repair/Private Work/Private Service – A repair, change, modification or work of any kind carried out on the Customer’s vehicle, at the request of the Customer and paid for in full by the Customer.

Insurance Job/Insurance Repair/Insurance Work/Insurance Service – A repair, change, modification or work of any kind carried out on the Customer’s vehicle, at the request of the Customer’s insurance company or a third party insurance company.

Excess – An amount of money owed to the Customer’s insurance company, to be paid to the Customer’s insurance company directly or via S.H.M Bodyworx. The excess amount is decided by the insurance company, not S.H.M Bodyworx.

Terms

These Terms constitute the contract between S.H.M Bodyworx Ltd and the Customer.

Any person making an enquiry, via telephone, online at the website or in person, must be at least 18 years of age and resident in the UK.

A contract will be binding between S.H.M Bodyworx Ltd and the Customer at the time of booking an estimate or repair or the arrival of the vehicle on site.

The Terms do not affect the Customers’ Statutory rights. The Customer is deemed to have accepted these Terms if they or their representatives give us instructions or place a Work Order or for goods to be supplied, which will only come into being upon the acceptance of S.H.M Bodyworx Ltd.

Estimates

An estimate given for a repair is the approximate cost of that repair – without dismantling the vehicle for detailed inspection – and is valid for 14 days.

Prices of Goods/Materials and Services are current at the time of the estimate and S.H.M Bodyworx reserves the right to increase the Contract price should additional repairs be found to be necessary upon dismantling of the vehicle, or if the price of Goods/Materials to Us increases between the time of the estimate and completion of the Repairs/Work.

If during the progress of work the estimate will be exceeded by any Material amount, S.H.M Bodyworx will obtain permission from the Customer to continue. A charge may be made for the estimate.

All costs quoted are subject to VAT.

Changes To A Repair/Job/Project

The Customer must assume that all additions, alterations, changes of repairs needed, or process changes requested by the customer, will alter the time and cost. The Customer shall offer S.H.M Bodyworx the first opportunity to make any changes.

If the Work/Repair can’t be carried out within the quoted period due to circumstances beyond Our control, a member of the Team will contact the Customer and advise them accordingly.

Delays may be caused by parts being unavailable, not delivered on time, delays by the Insurers, the Repair required may take longer to complete or special parts may be required.

Any variation of the estimated time of completion will be deemed an amendment and shall not constitute a new contract. S.H.M Bodyworx Ltd will endeavour to complete repairs by the date requested but can’t accept responsibility for any delay resulting from a cause beyond Our control.

Any liability for additional costs and or inconvenience resulting from such delays is not the responsibility of S.H.M Bodyworx or its employees, representatives or agencies.

Cancellation Of A Job/Project

In the event of cancellation of a work order, any deposit already paid, and expenses already incurred, shall be paid by the Customer.  If the job is a Private Job the and project is cancelled by the Customer, the Customer agrees to pay no less than 100% of the hours already billed and owed for the Work at the time of cancellation.

If the Job is cancelled by S.H.M Bodyworx, then we will do out utmost to cancel the Job in a satisfactory way and time limit. Reasons for the cancellation of the Job will be given to the Customer as early on as possible. Any monies already paid by the Customer to S.H.M Bodyworx will be discussed with the Customer and Manager of S.H.M Bodyworx.

Contact Between S.H.M Bodyworx and the Customer

Phone will be the main method of contact with regard to all communication, contact by email will be the secondary method. Therefore it is the Customer’s responsibility to notify us as soon as possible with any change in phone numbers or email address. We will acknowledge all emails within 2 working days.

S.H.M Bodyworx can not be held liable in any way relating to issues of communication if we are not supplied a valid email address or phone number.

If necessary, we will attempt to contact the Customer by phone, using the details given at the beginning of the Work Order. If the Customer does not respond to contact after 3 days we may freeze the Work Order until the Customer has made contact.

If the Customer has made S.H.M Bodyworx aware of time away – for example a holiday or time where contact will be temporarily halted for personal reasons – then the above will not apply and the Job will continue as normal.

If the Customer has not made any contact within 14 days, despite our further attempts to contact them, the Job may be terminated and any deposit will be kept, and 100% of the expenses already incurred will be owed to S.H.M Bodyworx by the Customer.

Parts Used

All parts used will adhere to the manufacturer’s standards and will be original, therefore ensuring that warranties are validated, unless otherwise agreed upon either verbally or in writing. S.H.M Bodyworx reserves the right to ask for payment in advance for all special orders and reserves the right to make a handling charge for goods returned which have been correctly supplied in accordance with the original order.

All parts which are replaced during the repair process, except where they have to be returned to the manufacturer or supplier become the property of S.H.M Bodyworx Ltd unless the customer requests their return prior to the start of the repairs.

Parts and other Goods supplied must be paid for in full on collection or delivery. All monies relating to Services provided must be paid upon delivery or when the Company notifies the Customer that the work is complete.

Title and ownership of Goods and Services supplied will pass only when payment has been received and monies cleared.

Payment for all Goods and or Services, Repairs and or parts supplied is due on completion of work.

All Goods/Services shall remain the property of S.H.M Bodyworx until We have received cleared payment in full from the Customer.

Cheques are not accepted; some card payments may incur charges.

If payment is not received for Insurance excess, VAT or total invoice amount within 5 days of repair completion, a late payment interest will be applied along with administration costs.

Vehicles will not be released until payments/cleared funds have been received in full.

Default In Payment

The Customer shall assume responsibility for cost outlays by S.H.M Bodyworx in all collections of unpaid fees and of legal fees necessitated by default in payment. Invoices in default will include but are not limited to fees for collection and legal costs.

Parts and other Goods supplied must be paid for in full on collection or delivery. All monies relating to Services provided must be paid upon delivery or when the Company notifies the Customer that the work is complete.

Title and ownership of Goods and Services supplied will pass only when payment has been received and monies cleared.

Payment for all Goods and or Services, Repairs and or parts supplied is due on completion of work.

All Goods/Services shall remain the property of S.H.M Bodyworx until We have received cleared payment in full from the Customer.

Cheques are not accepted; some card payments may incur charges.

If payment is not received for Insurance excess, VAT or total invoice amount within 5 days of repair completion, a late payment interest will be applied along with administration costs.

Vehicles will not be released until payments/cleared funds have been received in full.

Following the completion of services, if the Customer’s vehicle(s) is left at Our premises, We reserve the right to make a daily charge for the storage of the vehicle(s).

Any vehicle which is not collected by the Customer and where payment for repairs carried out has not been made within 6 calendar months of the Customer having been advised of the completion of the work, may be sold by S.H.M Bodyworx Ltd and the cost of repairs and any storage charges may be deducted by Us from the net proceeds of the sale of the vehicle.

Before proceeding to sell the vehicle, S.H.M Bodyworx will give the Customer 7 working days’ written notice of its intention to do so.

You will be able to access the majority of this Website without having to register any details with us. (However, particular areas of this Website will only be accessible only if you have registered.)

Website Use By Visitors/Customers

With the exception of personally identifiable information, the use of which is covered under our Privacy Policy, any material you send or post to this Website shall be considered non-proprietary and not confidential. Unless you advise to the contrary we will be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all purposes.

This is something we do not freely do however, we do not give away or sell your information to anyone unless required to do so by law or to continue with any order made eg giving your name and address to any third party we may need to liaise with in order to carry out the Work.

Should any legal issues or claims arise from the content or copyright of any images used by the Customer or any other person, any issues and claims will be the sole responsibility of the Customer/other person.

S.H.M Bodyworx cannot take responsibility for any losses incurred by the use of our Website or products by the Customer. Whilst every care has been taken to ensure our Website and products are problem free and accurate, the ultimate responsibility lies with the Customer in ensuring that all Website and products are functioning correctly before use.

Limitation Of Liability

S.H.M Bodyworx expects the Customer to carry out any checks and/or research before requesting a Service from S.H.M Bodyworx. This includes making sure that the nature of use of any products or material is legal and will be operating within the law, not harmful to others in any way and not harmful to the Customer themselves – including electrical or hybrid vehicles, illegally bought vehicles, vehicles containing illegal or dangerous liquids/drugs/drug paraphernalia.

It is of great importance that the use of our services is not in any way illegal nor instigates, promotes or encourages anything illegal. This includes but is not exhaustive of anything racial, sexist, terror inciting, sexual exploitation and scams of any kind.

The Customer agrees that it shall not hold S.H.M Bodyworx or their agents or any employees liable for any incidental or consequential damages that arise from products, repairs, work or material provided by S.H.M Bodyworx or from S.H.M Bodyworx’s failure to perform any aspect of the Job in a timely manner, regardless of whether such failure was caused intentional or negligent acts or omissions of S.H.M Bodyworx or Customer, any Customer representatives or employees, or a third party.

S.H.M Bodyworx cannot be held responsible for anything that may affect the Customer’s operation of business, any sales, or the Customer’s profitability that might be claimed as a result of a service/product offered by S.H.M Bodyworx.

S.H.M Bodyworx Ltd will not be held liable for any damage or delay in the services provided in cases of ‘Act of God’, ‘Industrial action/strikes’ Government Disputes or factors deemed out of our control.

We will not be held responsible for any loss of valuable items left by the Customer and are not connected to the vehicle or damage to such items. We shall take reasonable care of the vehicle while in our care. S.H.M Bodyworx and its employees cannot accept liability for the loss of or damage to personal property or business goods left in the vehicle. We advise that all items are removed from the vehicle prior to your visit to our place of business.

Descriptions of, or references to information, products, services or publications within the Customer’s business do not constitute or imply their endorsement or recommendation in any way by S.H.M Bodyworx.

S.H.M Bodyworx cannot take responsibility for any losses incurred by the use of any product, Service, Work Order, or Website to the Customer. Whilst every care has been taken to ensure our Website, Services and products are problem free and accurate, the ultimate responsibility lies with the Customer in ensuring that all software, repairs and products are functioning correctly before use.

S.H.M Bodyworx is not liable for loss, damage or corruption to information stored on their servers or individual PCs relating to a Customer’s purchase/order/or business. The Customer is solely responsible for any information or product use relating to any products or services made, used by or bought from S.H.M Bodyworx.

S.H.M Bodyworx will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Health and Safety laws will apply where applicable when carrying out repairs to Customer’s vehicles. 

S.H.M Bodyworx will not be liable for any costs incurred, compensation or loss of earnings due to the Work Order made out on behalf of the Customer or any of the Customer’s appointed agents.

S.H.M Bodyworx will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software, hardware, machinery, tools, products or any material provided by its agents.

S.H.M Bodyworx will not be liable or become involved in any disputes between the Customer and their Insurers and cannot be held responsible for any wrongdoing on the part of a Customer or Insurer.

S.H.M Bodyworx cannot be held responsible for problems or additional costs arising due to any errors made by third parties, or failure to maintain a current copy of the Customer’s own details or Work Orders.

S.H.M Bodyworx has no control of, or responsibility for, the content of Customers’ vehicles/business/personal items or their use of vehicles.

In no way does the textual or image based Content of our Customer’s Websites/social media accounts constitute S.H.M Bodyworx endorsement, or approval of the Website/social media account or the material contained within the Website/social media account.

S.H.M Bodyworx has not verified any of the materials, images or information contained within the Customer’s Websites/social media account and is not responsible for the content or performance of these sites or for the Customer’s transactions with them.

S.H.M Bodyworx provides links or references to the third party Websites solely for the convenience of prospective customers and intends that the links it provides be current and accurate, but does not guarantee or warrant that such links will point to the intended third party site at all times.

S.H.M Bodyworx makes no claims that the contents of this Website may be lawfully viewed or downloaded outside England and Wales. Access to the Website of shmbodyworx.com may not be legal by certain persons or in certain countries.

S.H.M Bodyworx cannot be held responsible for anything that may affect the Customer’s health, physical well-being or relationship well-being that might be claimed as a result of a service/product offered by S.H.M Bodyworx.

S.H.M Bodyworx will retain information on the invoice for repairs, sales, and warranty purposes as Data Controllers. This information will be shared with the vehicle manufacturer and other parties relevant to the repair procedure. S.H.M Bodyworx, the vehicle manufacturer and other relevant parties may contact the Customer to inform the Customer of products or services which may be of interest or may be asked to participate in a Customer Survey by the vehicle manufacturer. The Customer has the right to refuse the processing of information.

This warranty does not extend to any uses that the Customer or others may make of S.H.M Bodyworx’s products that may infringe on the rights of others. The Customer expressly agrees that it will hold S.H.M Bodyworx harmless for all liability caused by the Customer’s use of S.H.M Bodyworx’s products, Services or results of Wok Orders to the extent such use infringes on the rights of others.

Governing Jurisdiction

This Legal Notice shall be governed by and construed in accordance with English law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England and Wales.

Acceptance Of Terms

The action of the sending and receipt of this agreement via electronic method/use of the Website/making a Purchase will hold both parties in acceptance of these terms.

S.H.M Bodyworx as sender and the Customer as the recipient will acknowledge acceptance of these terms either through an email noting acceptance or acceptance is acknowledged at the completion of a Work Order. Any electronic signatures shall be considered legal and binding.

By placing a Work Order or purchasing Services from S.H.M Bodyworx, you confirm that you are in agreement with and are bound by the Terms and Conditions above.

The signature/Purchase/use of our Website – electronic or otherwise – of both parties shall act as evidence of acceptance of these terms.

The Customer realises that by placing a Wok Order that they are agreeing to the Terms and Conditions of S.H.M Bodyworx for the period of time it takes to complete the Job.

These Terms and Conditions – including our Privacy Policy and the Right to Erasure and Download Data – are on the Website of S.H.M Bodyworx, a copy can also be provided to the Customer upon request.

S.H.M Bodyworx reserves the right to change these Terms and Conditions at any time. If these Terms and Conditions are changed then an updated version updated on the Website and we will attempt to notify the Customer of the changes.
